Universal Protection for Ai-Generated Contents Under Copyright Law: Navigating the Ownership and Originality Conundrum

Smart technologies have created the possibilities for machines to learn, understand, perceive, think, interact and produce desired contents without the faintest of human intervention. This novel idea has produced the realities of Artificial Intelligence which has become a global phenomenon. This article engages the impact of copyright regulations on original AI-generated works. Legal frameworks such as the Berne Convention, EU Copyright Law, and individual country legislations are carefully examined. Emerging originality and human impute-factors in Al creativity are critically analyzed with reference to relevant case law. Adopting the doctrinal research methodology which is strictly normative, the paper leverages on the approach of global institutions like the Court of Justice of European Union and the World Intellectual Property Organization to appreciate different engagements by individual nations of the world on the subject matter. Emphasis is laid on the necessity for statutory updates and bureaucratic dynamics to contain the challenges posed by Al-generated works without stifling innovations. A case is made for international collaboration and public enlightenment campaign in designing policies and legislations to protect the copyright of Al-generated works as the world embraces the regime of Artificial Intelligence. Proactive suggestions are put forward as recommendations for the guidance of legislators, policymakers and researchers engaged in the study of the AI evolution.
