The emergence of artificial intelligence (AI) systems capable of generating patentable inventions and creative works presents novel challenges for intellectual property (IP) jurisdictions worldwide. This article examines the challenges relating to ownership and infringement issues of different intellectual property rights. It also explores and analyzes the complex jurisdictional issues arising when AI creation and utilization spans international borders. Core analyses focus on uncertainties surrounding territorial nexus, governing law, liability attribution, and enforcement cooperation in cross-border AI-related IP disputes. The ambiguous fit of AI inventions within existing patent, copyright, trademark, and trade secret frameworks compounds difficulties in establishing proper jurisdiction and applicable law. Through comprehensive analysis and policy discussion, this article highlights the disconnect between AI technology and long-standing IP jurisdiction tenets reliant on human and corporate entities. Drawing upon emerging legal cases, academic theory, and policy proposals, solutions are presented to modernize outdated statutes, harmonize standards globally, incentivize disclosure, and facilitate dispute resolution in this sphere.
